The charges were dropped in 2007 after the jury was told that US government itself has effectively distributed the same videos, when it administered the sale of stock from a bankrupt video store chain.
Five Star , the studio, had faced obscenity charges connected with the distribution of the titles “Filthy Things 6,” “Gag Factor 15,” “Gag Factor 18” and “American Bukkake 13.” The government has overseen the sale of the same videos in administering the business of Castle Megastores following that company’s declaration of bankruptcy.The case against JM was thrown out because JM Studios had made the videos, but the prosecutor had no evidence that they had sold the movie to Five Star for distribution.
